TERMS OF SALE

1. Acceptance of Terms

By placing an order through this website, you (the “Customer”) agree to be bound by these Terms of Sale (the “Terms”). Colonial Acres Coins Ltd. (“Colonial Acres,” “we,” “us,” or “our”) reserves the right to amend these Terms at any time without prior notice. Continued use of the website constitutes acceptance of any revised Terms.

2. Customer Account Requirement

2.1 Customers must create and maintain an account in order to place an order on this website.

2.2 The Customer is responsible for maintaining the confidentiality of their account information and for all activities conducted under their account.

2.3 Colonial Acres reserves the right to suspend or terminate accounts at its sole discretion.

3. Orders and Processing

3.1 All orders are subject to acceptance and availability. Colonial Acres reserves the right to refuse or cancel any order at its sole discretion, including but not limited to orders containing pricing errors or typographical inaccuracies.

3.2 Orders are processed Monday through Friday, excluding statutory holidays. Processing and shipping delays may occur during peak periods.

3.3 Full payment is required at the time of order placement. Orders not paid within twenty-four (24) hours may be cancelled without notice.

3.4 Unpaid orders will be held for a maximum of fourteen (14) days. If payment is not received within this period, the order will be cancelled and items returned to inventory.

3.5 Colonial Acres does not combine orders.

3.6 Any adjustments or additions to orders must be requested within twenty-four (24) hours of placement and may result in delays in processing. No modifications will be permitted beyond this timeframe.

4. Pricing and Currency

4.1 All prices are listed in Canadian Dollars (CAD) and are subject to change without notice.

4.2 Colonial Acres shall not be held responsible for typographical errors, including pricing errors, and reserves the right to cancel any orders arising from such errors.

5. Shipping and Delivery

5.1 Estimated delivery times (following receipt of payment) are as follows:

• Canada: approximately two (2) weeks
• International: approximately four (4) to ten (10) weeks

5.2 Colonial Acres is not currently shipping to the United States.

5.3 Delivery times are estimates only and are not guaranteed. Delays may occur due to holidays, postal disruptions, or circumstances beyond our control.

5.4 Orders will only be shipped to the Customer’s billing address for security purposes.

5.5 Shipping fees, taxes, and applicable charges are calculated at checkout.

5.6 Free shipping is available for standard shipping within Canada on orders exceeding $500 CAD (before taxes). Free shipping does not apply to priority, U.S., or international shipments.

5.7 Additional shipping or handling charges may apply to oversized or heavy items.

6. Order Confirmation and Accuracy

6.1 Upon completion of payment, a confirmation email will be sent to the Customer.

6.2 The Customer is responsible for reviewing the order details for accuracy. Any changes to billing or shipping information must be requested immediately.

7. Pre-Order Items

7.1 “Pre-Order” items are items not currently in stock but confirmed to be incoming.

7.2 Orders containing pre-order items will not be shipped until all items are available, unless otherwise arranged.

7.3 Colonial Acres does not guarantee delivery dates for pre-order items.

7.4 Requests for split shipments may result in additional shipping charges.

8. In-Store Pickup

8.1 In-store pickup is available at 991 Victoria Street North, Kitchener, Ontario.

8.2 Customers will be notified by email when their order is ready for pickup. Customers must not attend prior to receiving such notification.

8.3 Orders not collected within twenty-one (21) days will be cancelled and refunded.

8.4 Orders originally designated for pick-up that are converted to shipping will incur applicable shipping fees and may experience delays.

9. Payment Terms

9.1 Accepted payment methods include:

• Visa and MasterCard
• PayPal
• E-Transfer
• Cheque, Money Order, Bank Draft
• E-Bill payments (participating financial institutions only)
• Wire Transfer
• Cash or Debit (AVAILABLE IN STORE ONLY)

9.2 Cheque and bank draft payments require up to ten (10) business days to clear before shipment and are subject to a corresponding hold.

9.3 E-transfer payments must include the invoice number and be submitted within twenty-four (24) hours. E-transfer payments are not accepted in-store.

9.4 Colonial Acres reserves the right to request alternative payment methods at its discretion.

9.5 Paypal is not available for items originating from or associated with countries subject to U.S. sanctions (including but not limited to Cuba, Iran, North Korea, Syria, etc). Such items will be clearly identified within their product descriptions.

9.6 Customers paying by Wire Transfer must contact the company once the transfer has been initiated to facilitate prompt processing.

9.7 Colonial Acres Coins reserves the right to cancel any orders containing bullion paid for by Credit Card or Paypal without notice.

10. International Orders

10.1 International orders may only be paid by International Money Order or Bank Draft. Credit cards or Paypal are not accepted.

10.2 Minimum shipping fees apply:

• Orders up to $500 CAD: $120 CAD minimum
• Orders over $500 CAD: $160 CAD minimum

10.3 Additional shipping charges may apply based on size and weight.

10.4 Colonial Acres does not ship to all countries.

11. Taxes

11.1 Applicable sales taxes are calculated based on the shipping destination within Canada.

11.2 Tax-exempt items will be adjusted automatically at checkout.

11.3 International orders are not subject to Canadian taxes; however, duties and brokerage fees may apply.

12. Returns and Refunds

12.1 Customers must notify Colonial Acres of any issues within fourteen (14) days of delivery. Returns may not be accepted outside of this return window.

12.2 Eligible returns must be:

• Unopened and unused
• In original packaging
• Accompanied by proof of purchase

12.3 Non-returnable items include:

• Bullion products
• Sale items
• Opened or handled items
• Items sold “as is”
• Jewellery
• Royal Canadian Mint Discount Centre products

12.4 A restocking fee of five percent (5%) to ten percent (10%) may apply.

12.5 Return shipping costs are the responsibility of the Customer unless the return is due to an error or defect.

12.6 Original shipping charges are non-refundable.

13. Sale Items and Special Sale Categories

13.1 All sale items are final sale and non-refundable, except where items are defective, incorrectly described, or shipped in error.

13.2 Special sale items, including but not limited to Blowout Specials, Unique Deals, Deals on Decimal, Deals on Paper Money, and Mega Specials, are sold “as is” and are final sale.

13.3 Special sale items are not eligible for return or exchange except where:

• The item has been materially misdescribed; or
• The item has damage that was not disclosed in the product description or product images

13.4 Customers are responsible for reviewing all product descriptions and images carefully prior to purchase.

13.5 Items from the Royal Canadian Mint Discount Centre and all jewellery items are final sale, subject to the same exceptions outlined above.

14. Bullion Transactions

14.1 All bullion sales are final and non-refundable. Requests to cancel a bullion order based on price fluctuations will result in a permanent prohibition from future purchases.

14.2 Bullion prices are subject to market fluctuations and will change without notice.

14.3 Colonial Acres reserves the right, at its sole discretion, to impose restrictions on payment methods and shipping options for bullion purchases.

14.4 Minor imperfections in bullion products such as small “dings”, minor toning, or milk spots are considered normal and do not constitute defects.

14.5 Colonial Acres shall not be liable for any fluctuations in bullion pricing after an order has been placed, as determined by changes in the market.

15. Order Holds

15.1 Paid orders may be held for up to fourteen (14) days upon request.

15.2 Unpaid orders will not be held for more than seven (7) days.

15.3 No order holds are permitted between November 15 and December 31.

16. Product Representation

16.1 Images displayed on the website are for illustrative purposes only and may not reflect the exact product received.

16.2 Colonial Acres does not guarantee specific serial numbers or exact item matching to images.

17. VIP Rewards Program

17.1 Participation in the VIP Rewards Program is subject to additional terms and conditions.

17.2 Colonial Acres reserves the right to modify or terminate the program at any time without notice.

17.3 Colonial Acres reserves the right to suspend any VIP Rewards Program account for any reason at any time.

17.4 Points:

• Are awarded at time of shipment
• Are non-transferable and non-refundable
• Cannot be redeemed retroactively
• Can not be converted to cash or refunded
• Expire one (1) year from the date they are earned

17.5 Not all products qualify for points, such as:

• Bullion
• Sale items
• Special order items
• Other products as determined by Colonial Acres

17.6 Products that do qualify will be clearly identified in their online descriptions.

18. VIP Pricing

18.1 VIP pricing is available to eligible customers and is subject to change without notice.

18.2 Not all products qualify for VIP pricing, such as:

• Bullion
• Sale items
• Special order items
• Other products as determined by Colonial Acres

19. Limitation of Liability

19.1 Colonial Acres shall not be liable for any indirect, incidental, or consequential damages arising from the use of its website or products.

19.2 Colonial Acres is not responsible for delays caused by third-party carriers or events beyond its control.

20. Disclaimer of Warranties

20.1 The website, including all content, materials, and products made available through it, are provided on an “as is” and “as available” basis, without warranties or conditions of any kind, whether express or implied.

20.2 To the fullest extent permitted by applicable law, Colonial Acres Coins Ltd. expressly disclaims all warranties, representations, and conditions, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability;
• Fitness for a particular purpose; and
• Non-infringement of third-party rights.

20.3 Colonial Acres does not warrant or represent that:

• The functions or operation of the website will be uninterrupted, timely, secure, or error-free;
• Any defects or errors will be corrected; or
• The website or the servers that make it available are free of viruses or other harmful components.

20.4 Colonial Acres makes no warranties or representations regarding the accuracy, completeness, reliability, timeliness, or usefulness of any materials, information, or products available on the website.

20.5 The Customer acknowledges that use of the website and reliance on any materials or products is at their own risk.

20.6 Some jurisdictions may not allow limitations on implied warranties. In such cases, certain portions of the above disclaimers may not apply, and the Customer may have additional rights under applicable law.

21. Indemnification

21.1 The Customer agrees to indemnify, defend, and hold harmless Colonial Acres Coins Ltd., its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including legal fees, arising from or related to:

• The Customer’s breach of these Terms;
• The Customer’s misuse of the website or products;
• Any violation of applicable laws or regulations; or
• Any infringement of third-party rights.

22. General Provisions

22.1 All in-store purchases and pickups are final.

22.2 Shipping fees are non-refundable.

22.3 Colonial Acres reserves the right to limit quantities and cancel orders at its discretion.

23. Customer Conduct and Harassment Policy

23.1 Colonial Acres is committed to maintaining a safe, respectful, and professional environment for its employees, representatives, and customers.

23.2 The Customer agrees not to engage in any form of harassment, abuse, or inappropriate conduct toward Colonial Acres staff, whether through:

• Email, telephone, or written communication;
• Social media or online platforms; or
• In-person interactions at our retail location.

23.3 Prohibited conduct includes, but is not limited to:

• Threatening, abusive, or discriminatory language;
• Harassment based on race, gender, religion, nationality, or other protected characteristics;
• Repeated or excessive communications of a harassing nature;
• Any conduct that creates a hostile or unsafe environment for staff or other customers.

23.4 Colonial Acres reserves the right, at its sole discretion, to:

• Refuse service;
• Cancel existing orders;
• Terminate or suspend customer accounts; and/or
• Refuse future transactions

in response to any conduct deemed to violate this policy.

23.5 Where appropriate, Colonial Acres reserves the right to report threatening or unlawful behavior to law enforcement authorities.

24. Royal Canadian Mint Product

24.1 All Royal Canadian Mint products come complete with original Mint packaging and Certificates of Authenticity (COAs), and are carefully handled and stored in gently used condition unless otherwise noted. As is common with Royal Canadian Mint items, you may notice light rim toning or minor marks on capsules, which are a natural part of ownership and do not affect the quality or authenticity of the piece.
